Questions About Association Issued Documents
Who does my association issued documents really belong to? Who stipulates how they are to be used? How can they be used? Can they be used in any other manner than specified by my association? What if my association doe not have a policy about the documents issued? Do I ever have to return them? What are they used for? Why were these documents issued to begin with? When did 59-65-47 associations start issuing them? Do I have to provide anyone that asks with a copy of my association issued documents? Why would anyone want or need to keep copies of our association issued documents? Do we have to give them a copy? If they ask to take my original so they can make a copy, should I let them? Why should I never allow anyone to take my association issued documents (even though they might tell me they will bring them back later)? How do I get educational discounts, if my association does not issue paperwork?

Technically, (just as with credit cards, and other documents issued by any agency that holds the power to terminate your credit line, membership, etc.) they belong to the issuing association.
Just as any issuing agency that holds the power to grant privileges, or revoke privileges to such documents the same agency holds the authority and right to stipulate the use of such documents.
Documents may be used as specified by your home school association. Most commonly they are for obtaining discounts on educational materials. Members can utilize them in the local community for obtaining special teacher and homeschooling discounts offered in bookstores, on field trips, and other educational opportunities.
No, only your association has the right and authority to determine the use of documents they issue.
Then you must use your discretion, making sure to protect your right to privacy.
Technically no. However if your membership has been terminated by either you or your association, and you use any document provided by that association in any way, you can be held legally liable.
Most commonly these documents have been provided to you so that you may use them to obtain discounts offered to home schools on educational materials, and activities.
CHASE SC in 1996 issued to all members membership certificates and membership cards, at the request of many homeschoolers who wished to receive homeschooling discounts at various stores.
Again it was in 1996, when homeschoolers asked for them to obtain discounts.
No, you do not have to provide any association issued documents to anyone unless they have a court order that legally orders you to do so.
There is no known valid legal reason for anyone to collect copies of your paperwork. Nor is there any known valid legal reason for anyone to maintain such copies.
(even though they might tell me they will bring them back later)? What evidence would you be left with if a school official takes your paperwork, and leaves your residence? Then sends a non school official (DSS or Police Officer) to your door, who refuses to call your association for verification of your legitimacy at time of contact. Although, you could easily be defended legally in any court action that may arise out of such contact, why would you place yourself in such a predicament? If you are not a member of HSLDA, can you afford an attorney that 'knows' SC homeschool law? Under 59-65-47, your association is the only one required to provide any documentation to the local school district. Under 59-65-47, you are not required to provide any documentation to a school official. Furthermore, under 59-65-47, the only information that your association must provide to the local school district is the number of students in each grade level to their prospective school districts.
How do I get educational discounts, if my association does not issue paperwork? You may create your own school card, stationary, or other letter needed for the discount from your homeschool. Make sure to use your school name when designing your school cards, stationary, or letters. |
