Questions About Expelled Students Earning Credit

What does the law say about expelled students?
Can students that were expelled from a public or private school be homeschooled the remainder of the school year,
and still receive credit at the public or private school when enrolling for the next school year?

Can we still homeschool even if the child will not get any credit?
What about third option accountability associations?
If we have made the commitment to home school our child for the long haul,
will they be able to retain any grade placement or credits they earn during the expelled term period?

What does the law say about expelled students?

SECTION 59-65-80. Enrollment or attendance of expelled or suspended child not authorized.

Nothing herein shall be construed as granting authority to require enrollment or attendance of a child who has been or may be expelled or suspended by the board of trustees of the district or any other person acting with authority from the board of trustees.

Can students that were expelled from a public or private school be homeschooled the remainder of the school year,
and still receive credit at the public or private school when enrolling for the next school year?

The public or private school that the student was expelled from is not required to accept any grades completed or high school credits earned under theses circumstances. Most public schools will not honor any grade completed or credits earned. Private schools may or may not. The parent and student need to consult with the principal or administrator and find out what the school's policy is. If they will accept you child's home school program, and honor the grade placement and/or the credits that they earn make sure to get all in writing (include their policies and stipulations).

Can we still homeschool even if the child will not get any credit?

Yes, you can. Education is the goal, not how many credits are earned, what a great life long lesson to teach your child! Perhaps their homeschooling experience will help them to get back onto the right track. It certainly will help others to see that the student is trying to change and aiming for success.

What about third option accountability associations?

Each association's rules and policies are different. You will have to consult with those associations that you are interested in to find out which ones will consider an application for an expelled student. Most homeschooling associations will only consider accepting an application for an expelled student if the parent is considering long term home schooling, or already has made the commitment to home school for the long haul.

If we have made the commitment to home school our child for the long haul,
will they be able to retain any grade placement or credits they earn during the expelled term period?

If an association approves the application, the family continues to homeschool the student (long term), the student may be able to retain the grade placement and credits they earned. Please check with those associations that you are interested in to find out their policies.
